Q : What steps does the employer take, to get a work permit?

A : The employer carries out a labor market test. The test must confirm that there are no Polish or EU nationals who could be employed in a given position.

The process is as follows :

Employers submit notification of vacancy to the County Labor Office, who analyze records of all unemployed people and job seekers who may be suitable for the vacant position. Only if there is no suitable candidate from the existing records for the vacancy, shall the county commissioner issue the relevant decision. 

Q : Under what conditions is the labor test not conducted?

A : 1) The work is included in the list of occupations which are in great demand - these are specified by the local Voivode.

2) The work permit is being extended for the same person for the same job.

3) The foreigner is taking employment within a domestic household.
